简介:Near30yearsaftertheadoptionofthe1986UNDeclarationontheRighttoDevelopment,understandingofthisRightstilldiffersfromonepoliticalgrouptoanother.TheSouthstressesissuessuchasinequalitiesintheinternationalfinancialsystem,greaterparticipationofdevelopingcountriesinglobaldecision-makingoneconomicpolicy,andpromotingafairertraderegime.TheNorthpersistsonaptdomesticconditionsindevelopingcountriessuchasruleoflaw,goodgovernance,democracyandresponsibleeconomicmanagement.AndwhiletheNonAlignedMovementcallsforaninternationallegalstandardofabindingnature,theEuropeanUnionisopposedtosuchanupgradeoftheDeclaration.Infact,draftingaFrameworkConventionontheRighttoDevelopmentseemstobethebestoptionforaccommodatingtheconcernsofthedifferentpoliticalgroups,asitallowsforastep-by-stepapproach.Aframeworkconventionisatreatyunderinternationallaw:suchatreatyisopentoStates,andonceithasenteredintoforce,itisbindingonStatesthathaveexpressedconsent.ThepotentialaddedvalueofaFrameworkConventionontheRighttoDevelopmentistobalancethecurrenthumanrightsregimewithatreatythatgoesbeyondindividualStateresponsibilityandtakesinspirationfromprinciplesderivedfrominternationaldevelopmentefforts,suchasmutualaccountability,alignmentofpoliciesamongpartnercountries,andinclusivepartnerships.
