简介:摘要:《民法典》实施后,抵押期间抵押财产转让规则从限制转让转变为自由转让,取消了抵押权人同意制度,并明确提出抵押权追及效力,有力地保护了抵押人、抵押权人、受让人的合法权益。从带抵押不动产自由转让规则的价值目的及“带押过户”现实要求出发,深入评析全国各地推行的“带押过户”办理模式,可以看出“资金自由监管+登记业务三合一”登记模式更能契合《民法典》第406条的立法目的和营商环境的工作要求,登记机构落实“带押过户”业务办理中还需要从机构协同、便民登记、推广力度等方面进一步优化和完善。
